Terms of Service

1. Agreement to Terms

By accessing or using Soulbound Stories ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Soulbound Stories is a platform that allows users to create scheduled messages, memories, and memorial content for their loved ones. The Service includes:

  • Creating and managing loved one profiles
  • Scheduling automated email messages
  • Recording memories and life stories
  • Creating interview-style Q&A content
  • Public memorial pages
  • Alive-check monitoring and death confirmation workflows

3. Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. User Accounts

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access. We are not liable for losses arising from unauthorized account use.

5. Subscriptions & Payments

Soulbound Stories offers Free and Premium subscription tiers. Premium plans are available as Monthly ($2.99/mo), Yearly ($24.99/yr), or Lifetime ($149 one-time).

  • Purchases are made through Polar, our Merchant of Record. Polar is the seller of record for your transaction, and your purchase is also subject to Polar's terms.
  • Applicable taxes (VAT, sales tax) are calculated and collected by Polar at checkout.
  • Monthly and yearly subscriptions auto-renew until cancelled. You can cancel anytime from Settings or the billing portal; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Refunds: first-time purchases (including Lifetime) are refundable in full within 14 days of purchase. Renewal payments are non-refundable except where required by applicable law. Cancelling stops future billing; partial billing periods are not prorated. Refunds are processed by Polar — contact us at the address in the Contact section and we will arrange it.
  • The Lifetime plan is a one-time purchase granting Premium access for the lifetime of the Service (see Section 10), not the lifetime of any individual.
  • When a subscription expires, your account is frozen (read-only). No data is deleted.
  • Life-critical features (alive checks, death confirmation, and messages scheduled for after your passing) continue for up to 100 days after expiry.
  • Legacy Delivery: if your passing is confirmed while your account is in good standing (an active subscription, the Lifetime plan, the free tier, or within the 100-day grace period), your account enters legacy mode: billing stops immediately and we will use commercially reasonable efforts to deliver the messages you scheduled for after your passing, with no further payment required. An account that expired beyond the grace period before your passing does not qualify. Legacy delivery is a best-effort commitment, not a guarantee, and is subject to the disclaimers in Sections 8–10 and the limitations in Section 12.

6. User Content

You retain ownership of all content you create on the platform. By using the Service, you grant us a limited license to store, process, and deliver your content as necessary to provide the Service.

You agree not to upload content that:

  • Is unlawful, harmful, threatening, abusive, or defamatory
  • Violates any third-party rights
  • Contains malware, spam, or malicious code
  • Impersonates another person

7. Loved Ones & Third-Party Recipients

When you add a loved one, they will receive a verification email. Messages are only delivered to verified recipients. You are responsible for ensuring that the people you add have a reasonable expectation of receiving messages from you.

You acknowledge that loved ones may be contacted for death confirmation purposes if you designate them as emergency contacts.

8. Alive Checks & Death Confirmation

The alive-check system sends periodic emails requesting confirmation that you are alive. After multiple missed checks, your emergency contacts will be asked to confirm your status. This process is automated and best-effort.

We make no guarantee about the timing or accuracy of death detection. The system may produce errors in either direction — including failing to detect a passing, or initiating the confirmation process for a living user (for example, when check-in messages go unanswered). You agree that we are not liable for the consequences of such errors. The system should not be used as the sole mechanism for time-critical notifications or in place of an estate plan, will, or other legal arrangements.

9. Disclaimer of Warranties; Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any message will be delivered, or delivered at any particular time.

Without limiting the above, you acknowledge that delivery of messages — including messages scheduled years or decades in the future — depends on factors that cannot be fully controlled, including:

  • Software errors, defects, or data corruption despite reasonable engineering practices
  • Failures of third-party providers (email delivery, SMS, payment, hosting, storage)
  • Recipient email addresses that change, expire, or reject mail
  • Security incidents or unauthorized access, despite the safeguards we maintain
  • Events beyond our reasonable control (force majeure)

We implement reasonable technical and organizational security measures, but no system is completely secure, and we do not warrant that unauthorized third parties will never defeat those measures.

10. Service Changes & Discontinuation

We may modify, suspend, or discontinue the Service (in whole or in part) at any time. If we discontinue the Service entirely, we will use commercially reasonable efforts to (a) notify registered users by email at least 90 days in advance where practicable, and (b) keep the data-export feature available during that notice period so you can download your content.

You acknowledge that messages scheduled for delivery after a discontinuation date will not be delivered, and that "Lifetime" access means access for the lifetime of the Service. To the maximum extent permitted by law, we shall have no liability arising from any modification, suspension, or discontinuation of the Service, including for undelivered messages.

11. Termination

You may delete your account at any time from Settings. Upon deletion:

  • Your account is immediately deactivated (soft-deleted)
  • All automations are paused
  • Your data is permanently purged after 30 days
  • This action is irreversible after the 30-day window

We reserve the right to suspend or terminate accounts that violate these Terms.

12. Limitation of Liability

To the maximum extent permitted by law, Soulbound Stories and its operators shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, or for loss of data, loss of profits, or emotional distress, arising from or related to the Service. Without limiting the foregoing, we shall not be liable for damages arising from:

  • Failed, delayed, misdirected, or undelivered messages (including legacy/posthumous messages)
  • Software errors, bugs, or data loss or corruption
  • Unauthorized access to, or disclosure of, your data resulting from a security incident
  • Errors in the alive-check or death-confirmation process, in either direction
  • Acts or omissions of third-party providers (email, SMS, payments, hosting, storage)
  • Modification, suspension, or discontinuation of the Service

In all cases, our total aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the claim (or $50 if you paid nothing). Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded, including statutory data-protection rights.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
